Jail incarceration is very often used as a consequence for being found guilty of breaking the law. This consequence is reserved for some offenders, perhaps those who have been found guilty of the most heinous of offenses. It is also used for those multiple offenders who have not been deterred from their patterns of behavior through probationary measures. The freedom from jail time is certainly preferable.
