There may come a point in your marriage when a breakup is inevitable and if that happens a good divorce lawyer will be the first item on a list of things to do; you will want them to possess certain attributes for instance:

  • Competent in this field
  • Have the right frame of mind for this type of work
  • Be reliable

As far as experience is concerned, an attorney should be able to show that at least half of their work involves divorce cases and have good negotiation skills as well. It also follows that you feel comfortable with them and feel confident they will serve you well.

Adversarial attorneys will use the hammer to crack a walnut approach which often happens when these cases go to court whereas an attorney who specializes in mediation will take a much calmer approach. Some of the work load will be yours so you need to ensure you are well prepared each time you speak with your divorce lawyer and know exactly what they need from you and vice versa.

This is best done by knowing exactly what you intend to speak to them about and write down questions and answers in addition to when, and the length of the conversation on each occasion. Keep a file for all your notes, letters and documents so do as much as possible on the phone and by mail to keep the office time at a minimum.

Your attorney is there for advice and any foreseeable legal actions so do not rely on them for anything but what you are paying them for, and especially not as a shoulder to cry on. Try not to involve your divorce lawyer with any tales of bickering that you and your ex-partner are involved in that are not directly pertinent to the divorce.

Being in control of your own case and your own life is the single best thing you can do, so it is essential that you have a lawyer who can work on that basis. You are employing them for their experience but at the same time you need them to understand that it is your divorce and you want to make the decisions about how it is too proceed. As the person paying for their service, you should expect to be sent copies of any relevant documents and if there are any issues that need to be clarified that a prompt response by them is expected.

If money is an issue, it may be a preferable for you to only contact a lawyer for legal advice on a marital settlement but not representation. This means that a little research is necessary on your part but once you have completed this, it is much easier to contact a lawyer to ask them specific questions and how they see your case concluding. It is not uncommon for people to draw up their own marital settlements with the help of a divorce lawyer who is familiar with the case.
