Legal Advice From a Divorce Lawyer

In the unlikely event you have to retain the services of a divorce lawyer, you will need to know you have the right one; here’s some of the qualities to look for:

  • Well versed in divorce law
  • Have the right approach
  • Be dependable

Ideally your divorce attorney should be spending half their time dealing with divorce cases and preferably one who is a good mediator. They must be someone you can trust and work with comfortably; someone who has your confidence.

Attorneys that specialize in mediation cases will be able to give you sound advice for out of court settlements but if a court appearance is necessary, they will need experience. Although there will be tasks you need to perform on your own, if you need to speak to your divorce lawyer, write down exactly what help you want from them.

This is best done by knowing exactly what you intend to speak to them about and write down questions and answers in addition to when, and the length of the conversation on each occasion. Keep a record of all correspondence and conversations and try where possible to have conversations on the phone which will reduce the amount of time required to see them in person.

An attorney does not come cheap so use them only for the purpose you hired them for, legal advice, they are not there as an emotional problem solver, there are other professionals who specialize in that area. Stick to relevant facts when you contact your divorce lawyer; do not discuss other matters regarding your spouse unless they are pertinent to the divorce.

Let your lawyer know from the start that you will be in charge of the case and they are there for legal advice and not as someone to lean on when things start getting rough. It is important they know any decisions regarding the divorce are yours to make and they are there for their knowledge and experience in providing legal recommendations. Let them know that copies of any correspondence relating to the case will need to be sent to you along with any other information and if you contact them, to reply as quickly as possible.

If money is an issue, it may be a preferable for you to only contact a lawyer for legal advice on a marital settlement but not representation. This means that a little research is necessary on your part but once you have completed this, it is much easier to contact a lawyer to ask them specific questions and how they see your case concluding. It is not uncommon for people to draw up their own marital settlements with the help of a divorce lawyer who is familiar with the case.

Getting help from a Divorce Lawyer

If you are in the position of looking for a divorce lawyer then there are steps you need to take; some guidelines on what to look for are below:

  • Skilful in this type of case
  • Have the right approach
  • Be consistent in their work

You will need an attorney where at least fifty percent of their work is in this area and unless you’re expecting problems, preferably one trained in divorce mediation that practices it professionally. Still, you also need to feel at ease with them; someone who immediately instills a sense of trust.

Adversarial attorneys will use the hammer to crack a walnut approach which often happens when these cases go to court whereas an attorney who specializes in mediation will take a much calmer approach. Preparation for both your divorce lawyer and yourself is important so when you contact them, make sure you know exactly what you intend to question them about.

Whether you intend to see them or speak on the phone, write everything down as this is the most efficient way to utilize your legal representative and keep a record of dates and times you spoke with them. Try to keep actual meetings to a minimum and where points have to be clarified, use the phone or send a letter.

Regard your attorney as a resource, not someone you depend on for emotional support because they cost too much for you to use them for sympathy and consolation; besides, you have family and friends for that. Never trouble your divorce lawyer with trivial matters that do not directly concern the divorce.

Being in control of your own case and your own life is the single best thing you can do, so it is essential that you have a lawyer who can work on that basis. You are employing them for their experience but at the same time you need them to understand that it is your divorce and you want to make the decisions about how it is too proceed. Ask that you be sent copies of all documents and letters and let them know that you expect phone calls to be answered by the next working day after all you are the one paying the bills.

If money is an issue, it may be a preferable for you to only contact a lawyer for legal advice on a marital settlement but not representation. This means that a little research is necessary on your part but once you have completed this, it is much easier to contact a lawyer to ask them specific questions and how they see your case concluding. Marital settlements are something that can be arranged by the individuals involved and then have them checked by a divorce lawyer; then if things don’t work out, the lawyer can always be hired to make the divorce settlement.
