Blunders Lead to Increase in Medical Negligence No Win No Fee Claims
It is predicted that more patients than ever before will be left with no choice but to bring medical negligence no win no fee claims against the NHS this year. The rise follows reports of catalogues of blunders leaving many patients injured and unable to work. Because of such errors, the compensation paid following medical negligence no win no fee claims are vital to the patient’s future, paying for rent or mortgage payments and ongoing care if needed.
New regulations implemented at the beginning of April this year state that NHS Trusts must register with the Care Quality Commission and report errors to a central database, anonymously. Patient groups state that the regulations are not strict enough. They are concerned that deaths are being recorded as resulting from natural causes or untreatable injury when in reality negligence was to blame. They also point out that when a patient dies as a result of negligence, their family is not necessarily told about what happened.
The Department of Health’s own statistics suggest that half a million patients each year are harmed as a result of medical negligence, including during operations in NHS hospitals. Nonetheless, the figures show that only 30,000 formal complaints are made per year and only 6,000 medical negligence no win no fee claims are launched. This demonstrates that relatively few patients fully understand their right to make a medical negligence no win no fee claim. Patient groups argue that this is because they are not fully informed of any errors that occurred during their treatment.
Last year £870 million was paid in medical negligence no win no fee compensation to patients so that they could maintain their financial independence and benefit from ongoing care. However, the NHS litigation authority estimates that it could face as much as £10 billion of compensation payouts based on accident reports from hospitals.
Sadly, due to lack of funding for training, errors seem set to continue. This in turn means that more patients will lose out on their health, independence and financial freedom. Medical negligence no win no fee claims can help them get justice, but it is to be hoped that care improves.
